Terms of Service
1. Acceptance of Terms
By accessing or using Cuts Cal (the "Service"), operated by Help Me In Post LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service.
These Terms apply to all users, including show owners, team members, and any person who accesses the Service in any capacity.
2. The Service
Cuts Cal is a post-production scheduling and cuts calendar management tool designed for television and film production teams. The Service enables teams to track editorial milestones, manage crew assignments, and coordinate delivery schedules across episodes.
We reserve the right to modify, suspend, or discontinue the Service (or any feature) at any time with reasonable notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuance.
3. Accounts
To use the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and not share it with others
- Notify us immediately of any unauthorized access to your account
- Be responsible for all activity that occurs under your account
Accounts are personal. Each person on a show team must have their own account. You may not create accounts on behalf of others without their knowledge and consent.
4. Teams & Shows
Each show in Cuts Cal is a distinct workspace with its own team. Show Owners may invite collaborators ("Members") to access and contribute to that show's calendar.
Owner responsibilities: Show Owners are responsible for the actions of all Members they invite, for managing team membership (including revoking access when appropriate), and for any applicable subscription charges for that show.
Member access: Members have access to the show's scheduling data, including crew assignments and milestone dates. By accepting an invitation, Members acknowledge that show data visible to them may include commercially sensitive production information.
We do not transmit show data to any third party except as required to operate the Service or as required by law.
5. Your Data
You retain ownership of all data you enter into the Service, including production schedules, crew names, and rate information. You grant us a limited license to store and process that data solely to operate and improve the Service.
Data you enter may include personally identifiable information about crew members (names, contact information, compensation rates). You are responsible for ensuring you have the right to enter such information and that doing so complies with applicable law, including any obligations to the individuals whose information you provide.
We do not sell your data. We do not use your production data for advertising or profiling purposes.
6. Billing & Payments
Pricing: Billing is per show. Each active show you own is billed at the Owner base rate, plus a per-seat charge for each additional team Member you invite. Pricing details are displayed on the Subscription page and may be updated with 30 days' notice.
Charges: You authorize us (or our payment processor) to charge your payment method on the billing cycle applicable to each show. All charges are non-refundable except as required by applicable law or at our sole discretion.
Cancellation: You may cancel a show subscription at any time. Cancellation takes effect at the end of the current billing period; no prorated refunds are issued for partial periods.
Suspension: If a payment fails, we may suspend access to the affected show after reasonable notice. Access is restored upon payment of outstanding charges.

7. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe the intellectual property rights of any third party
- Upload or transmit malicious code, spam, or harmful content
- Attempt to gain unauthorized access to other users' accounts or show data
- Interfere with or disrupt the Service or its infrastructure
- Reverse-engineer, decompile, or derive source code from the Service
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
8. Intellectual Property
The Service, including its design, software, and documentation, is owned by Help Me In Post LLC and protected by copyright and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand assets without our prior written consent.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HELP ME IN POST LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Termination
Either party may terminate these Terms at any time. Upon termination, your right to access the Service ends immediately. We will retain your data for 30 days following termination, after which it may be deleted. You may export your data at any time while your account is active.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or by a notice within the Service at least 14 days before changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
